Unjust Justice

The plight of Alaina Giordano became known to me thanks to a post on Facebook. Read more here in Alaina's own words.

Basically, the story is that Alaina's ex-husband was somehow able to get permission from the courts to relocate their two children to a new life in a new state due to the fact that Alaina has breast cancer.

Yup, that is right. Alaina has been successfully battling breast cancer and her ex took her to court and got a judge to grant him the right to relocate their children from North Carolina to Illinois all so he can start a new job. (personally, I sense some vindictiveness on the part of the "father")

The judge used Alaina's breast cancer diagnosis as a reason why her ex should get custody. Since the judge is not clear about how long Alaina has to live, she gave custody to the ex. Huh?

This is ridiculous. No one has an expiration date stamped on the bottom of our feet and even with a cancer diagnosis, no one knows how much time we actually have.

These children need to be with their mother where they feel secure. She needs to be with her children, whom I am sure are her reason for fighting the cancer that threatens her life.

Her ex could relocate these children, die suddenly and unexpectedly and then what? The children are living where they have no friends or family. How traumatic would that be?

The point is that no one knows their life expectancy. To use cancer against someone is wrong. Where do we find these family court judges?

I am all too aware from personal experience how fathers are often not treated fairly in the family court system. Yes, it is true that men abuse the system also but isn't that why we should have judges who listen and do what is right by the children?

  1. If you knew the family from which she came, like her sister who has PRAYED for the Dad's death and are miserable vindictive people you'd feel otherwise. Judges consider facts and her family would undoubtedly wish to raise the kids and they are miserable vindictive nasty people. Sad but true. My post is Anonymous because her family would threaten physical violence. I have NO relationship with the family other than that they live in town after relocating from NJ.

  3. Gee. The last two comments kind of sound like they might be coming from Alaina's ex,or maybe his friends or family, no? "I have no relationship with the family..." Ha! " "Threaten physical violence"? Is that all you can come up with? YOU ARE A JOKE.

  5. I think it's a shame that you have no empathy for a mother with cancer losing her children to a father who is moving out of state. Instead of thinking about who's right, or who's wrong- you should try focusing on the children.

  6. Wow very very sad the way people are today!!! No mother should lose her children to this situation!!! Her children and her family are her backbone!!! I think I think we all need to help her fight this!!!! There are 2 sides to every story but the only one that I believe is true is Alaina's and she doesn't deserve to have her children taken away at all!!!!!!!!!!!

  7. It's also a shame you make accusations about this family, ie- praying for the father's death, threatening with physical violence, and describing her family as vindictive, nasty people. You must stoop to low-life levels of name calling when Alaina is only concerned with keeping her children and beating cancer. You lack empathy and humanity. I don't know how you can sleep at night.

  9. THIS GUYS A COMPLETE ASSHOLE EXCUSE MY LANGUAGE BUT THIS BEST DESCRIBES A PERSON THAT WOULD DO THIS TO HIS FAMILY. ALAINAS CHILDREN SHOULD BE WITH HER END OF STORY!! IT WAS HIS CHOICE TO MOVE TO CHICAGO AWAY FROM HIS CHILDREN AND SICK WIFE. HE SHOULD BE ASHAMED OF HIMSELF TALKING ABOUT A GOOD FAMILY THAT STICKS TOGETHER NOT RUNS LIKE A PUNK TO SERVE HIS OWN SELFISH NEEDS! GOD BLESS ALAINA AND HER WHOLE FAMILY... PS BE A MAN AND STOP HURTING YOUR CHILDREN!!!!

  10. The guy is a complete tool. If he wants to move, he should move. But don't take the kids. Sounds like a bitter ex-husband that's trying to get back at Alaina by using his own children instead of being a real man. What a punk.

    - Dad CHOSE to move to Chicago and left the children. (If mom & family are so terrible, why did you not take them or stay???)

  13. Yeah, I've heard stories of her ex and the suspicious marks on Alaina. Everything was kept a secret, but she seemed like a beaten dog. And it looks like he's still beating her....emotionally. Kicking a woman while she's down. What a man.

  14. The fact is the father left the state that his family lived in to move to a different state probably for financial gain. The children and mother are focusing on making a happy life in a place where they were comfortable. Who would give this man the ok to take his children away from there life to a new state with nobody familiar except there father. Poor kids, they are going to need counseling. I want to know who will watch the children when the father is at work? Why would you choose to put such stress and anxiety on two beautiful children. Control? Also would like to know if the mother is in remission, or is her cancer active? Either way I have compassion for her...

  15. Is alaina able to care for the children during cancer treatments? Not sure on the severity of the cancer
    Either way, the father shud not keep or take the children from the mother unless she is unfit or a danger to the children
    This is just crazy
    I know both parties and i am shocked

  16. The husband wants her to move to Chicago, but she won't. He left the state for a JOB, in which he makes MONEY to pay for her healthcare and bills, and most likely the Internet she uses to smear his name.

  17. Did he leave the state for a job? Or was it to follow his girlfriend? Exactly!
    And sorry, I have children and no amount of money could get me to leave a state without them like he did! Just saying.

  18. This is Alaina's sister. And I am not anonymous because I am not a coward! How bout you Kane. If you ask anyone that knows our family they will tell you that we are a loving affectionate compassionate huge Italian family. We have Sunday dinners, sleepovers with the kids, go to the beach together and really enjoy each others company. I have posted a photo album of our family that shows pure unsolicited love for one another. I am a preschool teacher with 2 kids of my own. My mother has worked in the summit school district for over 20 years. We have supported each other through every step of our lives. The fact that not one person, not even his own mother, showed up in court to testify on kane's behalf; because she did not believe in what he was doing ... Says a lot. The " dog" that has been treated unfairly will bark the loudest. And there is a lot of fight left in this pack of dogs! You have not won anything. This is not a game. Justice will be served!

  19. Kane, if you were smart you would let your kids stay with their mother where they belong. The fact that you are relocating them to another state (whether it is for them financially or not) while Alaina has cancer is unbelievable. The longer you resist, the worse you look.You will be known in the media as the heartless dad that took his kids away from his ex with cancer. Not only will this affect your reputation, but your career as well. Nobody wants to be attached to a human being that has pissed off so many people. That will follow you for the rest of your life. Be assured your name will be brought up in the media. Once that ball drops, it will be too late. Do the right thing now while you still have a chance.

  21. This is insane. The father wants HER to move out to Chigago. She doesn't want to move because she has a support network and a trusted medical team in NC. So what's the vindictive idiot do? He takes her to court (wastes a lot of time and energy that she has precious little of) and rips the kids from her. These are the only facts that one needs to hear in order to make a blanket judgement on the type of evil that she was married to. This man has the rest of his life to be an asshole. It's a shame that he's wasting so much of Alaina's time left and traumatizing his own children by using them as weapons in his sick game.

    Move to NC Kane, be there for your kids, let Alaina have what little time she has left with them, and quit your bratty behavior before you hurt those kids.
